The High Court of Solomon Islands has dismissed a case moved by the government to block Parliament from meeting tomorrow.
Parliament meeting tomorrow will see the Opposition bench table a no confidence motion against Prime Minister Manasseh Sogavare by his former Education Minister, Dr. Derek Sikua.Prime Minister Sogavare rallied a high powered legal team, led by Attorney General, Julian Moti, and Solicitor General, Reginald Teutao, to push for the Governor General's Proclamation for Parliament to meet 13th December declared void.
According to Prime Minister Sogavare, his office and cabinet were not consulted prior to the proclamation, hence breaching Parliamentary Standing Order.
The Government instead proposed Parliament meet on December 24 to pass a resolution to allow government to expend public funds for the first quarter of next year while awaiting the approval of next year's budget.
The Court heard that Government has no business for tomorrow's meeting and will not attend parliament.
In dismissing the case, High Court Judge, Justice Edwin Goldsbrough, said the Government's case was frivolous and vexatious.
Meanwhile, the Government will appeal the High Court's ruling.
