Chief Justice Sir Albert Palmer has ruled against the High Court challenge brought on by Opposition MP Mathew Wale.
The case challenged several aspects of Mr Sogavare's Prime Ministership.
This included claims that OUR Party did not register properly for this year's general election, and that a judicial review was underway into the Governor General's decision to go ahead with the Prime Ministerial election despite irregularities.
However, in his ruling, Chief Justice Palmer says that it was not up to the judiciary to fix what some may see as broken legislation.
Chief Justice Palmer held that the claim was an abuse of Court process and found that what was put forward by Hon. Wale’s lawyers were arguments that are not known to law.
Essentially, the Chief Justice held that the role of the Courts was simply to declare what the law is, and not what it ought to be.
