Jamie, the actual words of the constitution is "AT THE REQUEST OF THE MEMBER". The constitution does not mention at the request of the member or a legal representative. Whether you like it or not that is how the Constitution is drafted and you should go by the wording of the law and not to make assumptions.
On the question of whether Parliament will pass the motion, we can only know that had he asked for one. Unfortunately he didn't and I am not in a position to pre-empt the outcome.
